FarmInvestor.com (“we,” “us,” “our”) is an Alberta-based farmland real estate practice that helps qualified investors acquire Canadian farmland, including through closely-held limited partnerships of fewer than 40 investors under the prospectus exemptions in National Instrument 45-106. Farm real estate brokerage services are provided through Real Estate Centre under the trade name Farm Real Estate powered by Real Estate Centre, licensed by the Real Estate Council of Alberta.
This Statement explains what personal information we collect, why, how we use and share it, and your rights. It applies to our website, account portal, support channels, and related services (the “Services”), and should be read with our Terms of Service and Cookie Notice.
We comply with PIPEDA, Alberta’s PIPA, CASL, the PCMLTFA (administered by FINTRAC), and applicable Canadian securities legislation, including NI 45-106. Where another province’s privacy law applies (e.g. Quebec’s Law 25), we comply with that as well.
We use personal information to open and administer accounts; verify identity and meet FINTRAC, securities, and tax obligations; confirm investor eligibility under NI 45-106 and the under-40-investor limit; process transactions and distributions; prevent fraud and security incidents; improve the Services; send marketing communications (with consent); and comply with legal and regulatory requirements.
We obtain express consent for sensitive information (e.g. SIN, banking, biometric data) and for CASL-regulated marketing emails. We rely on implied or deemed consent for routine, expected uses necessary to deliver the Services. You may withdraw consent at any time, subject to legal or contractual restrictions and reasonable notice; doing so may limit our ability to provide the Services.
We do not sell your personal information. We share it only as needed with: (a) service providers under written confidentiality and safeguarding agreements (hosting, identity verification, payments, analytics, document signing); (b) regulated partners (exempt-market dealers, portfolio managers, trustees, custodians, transfer agents) for eligibility verification and regulatory reporting; (c) regulators and authorities where required or permitted by law, including FINTRAC, CRA, the OPC, the OIPC of Alberta, the Alberta Securities Commission, and law enforcement; and (d) counterparties in a merger, sale, or insolvency, with appropriate protections.
Personal information is primarily stored in Canada. Some service providers may process it outside Canada (including the U.S. and EU), where it may be subject to foreign laws including lawful access requests. To request the current list of jurisdictions involved, contact our Privacy Officer.
We retain personal information only as long as necessary for the purposes collected and as required by law:

We use strictly necessary, functional, analytics, and advertising cookies. We obtain consent through our cookie banner before setting non-essential cookies. You can manage preferences via our cookie settings or your browser. Disabling cookies may affect functionality.
We send commercial electronic messages only with consent and include sender identification and a working unsubscribe mechanism in every message, as required by CASL. You can also unsubscribe via unsubscribe@farminvestor.com. Transactional and regulatory messages (confirmations, tax slips, statements, security alerts) will continue regardless.
We use safeguards appropriate to the sensitivity of the information, including TLS 1.2+ encryption in transit, AES-256 at rest, role-based access with MFA, audit logging, vendor due diligence, employee training, vulnerability management, and a documented incident response process. No system is fully secure, and we cannot guarantee absolute protection.
If a breach creates a real risk of significant harm, we will, as soon as feasible, notify the OPC and affected individuals under PIPEDA, the Alberta OIPC where PIPA’s threshold is met, and any other organizations that can reduce the harm. We retain breach records for at least 24 months as required by PIPEDA.
You may, subject to PIPEDA and PIPA exceptions: access the personal information we hold about you and how it has been used or shared; correct inaccurate information; withdraw consent (subject to legal or contractual limits); request information about foreign service providers; and challenge our compliance. We respond to requests within 30 days as required by law, may verify your identity first, and may charge a permitted cost-recovery fee for access requests.

The Services are intended for individuals who are the age of majority in their province (18 in Alberta). We do not knowingly collect information from those under the age of majority, and will delete any such information promptly.
